1. Introduction

Welcome to Sol Gallery (“Gallery,” “we,” “our,” or “us”). By accessing our website [solgallery.cr], engaging with our services, attending events, or purchasing artworks, you (“you,” “your,” or “client”) agree to the following Terms and Conditions. These Terms govern all sales, use of our website, and participation in events. If you do not agree, you should refrain from using our services.

2. Intellectual Property

All artworks, photographs, text, and materials displayed on our website and within the Gallery are protected by copyright and intellectual property laws.

• Images and content are for viewing only.
• No reproduction, distribution, modification, or commercial use is permitted without the express written consent of Sol Gallery and/or the artist.
• Buyers of artwork do not acquire copyright; artists retain all intellectual property rights.

3. Purchases, Orders & Returns

Art purchases through Sol Gallery are governed by the following:

3.1 Payment

• Payment must be received in full, including applicable taxes, delivery, and insurance, before the artwork is released.
• Accepted payment methods: Credit/Debit Card (with processing fee), local or international bank transfer, cash, or Bitcoin.

3.2 Delivery & Risk

• Delivery and insurance costs are the responsibility of the buyer unless otherwise agreed in writing.
• Risk transfers to the buyer once the artwork is delivered to the client or the shipping carrier.
• The Gallery may store works for up to 14 days post-purchase, after which storage fees apply.

3.3 Returns & Cancellations

• All sales are final.
• Custom or commissioned works may not be canceled once production begins. A 50% deposit is required and non-refundable.

3.4 Accuracy

While we make every effort to represent works accurately, variations in color, texture, and scale may occur due to lighting or digital display. Clients are encouraged to view artworks in person whenever possible.

4. Events & RSVPs

By attending a Sol Gallery event, you acknowledge and agree to the following:

• RSVPs may be required for entry and are subject to cancellation policies.
• The Gallery reserves the right to limit attendance or deny entry.
• Photography, video, and audio recording may occur during events. Attendance constitutes consent to the use of your likeness for promotional purposes.
• Sol Gallery is not liable for personal injury, lost property, or damages incurred during events.

5. Privacy & Data Protection

We are committed to safeguarding your personal information. Sol Gallery uses ArtCloud as its secure Client Relationship Management (CRM) system.

5.1 Data Collected

• Name, email, phone number, preferences, and purchase history.
• Payment details: collected only for transactions (processed through secure third-party providers).

5.2 Use of Data

• Data is used to process sales, manage relationships, and communicate about upcoming exhibitions, events, and offerings.
• Email communications are opt-in/opt-out. WhatsApp communications are sent only to contacts who voluntarily provide their number.
• Personal information is never sold or shared with third parties.

5.3 Data Retention

• Information is kept until you request deletion.
• Invoices and sales records may be retained as required by law.

• The Gallery is not liable for content or services of third-party websites linked from our site.
• Liability is limited to the amount paid for the Artwork (excluding commissions already disbursed to artists).

8. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of Costa Rica.

• In the event of a dispute, the parties agree first to pursue good faith mediation or arbitration.
• If judicial resolution is necessary, disputes shall be brought exclusively in the courts of Costa Rica.
• For international transactions, U.S. law may be applied where relevant to payment processing.

9. Updates to Terms

Sol Gallery reserves the right to update or modify these Terms at any time. Updates will be posted on our website with the effective date. Continued use of our services constitutes acceptance of the updated Terms.
